Abstract
The Conseil d'Etat, 33 administrative tribunals and five
administrative courts of appeal decide claims against the
government in France. The government's actions are presumed to be
legitimate in French law, and the citizen bringing the claim
normally has the burden of proof. The judge's job is to
adjudicate disputes, not make law. Due to the secrecy allowed to
shroud various kinds of government information, it is sometimes
difficult to obtain evidence, which must be in writing rather
than oral. The increasingly international nature of society also
makes obtaining evidence difficult.
